GST CANCELLATION AT A GLANCE

What is GST registration cancellation?

GST registration cancellation ends a GSTIN registration from the effective date in the order. Businesses may apply when the applicable conditions are met. Corporate Mitras helps you organise an application and review the related compliance work.

START WITH YOUR CIRCUMSTANCES

When might cancellation be appropriate?

01

Business closure

You are discontinuing operations and need to review the GST registration closure process.

02

Transfer or restructuring

A full transfer, merger or change in business constitution requires a registration review.

03

Registration no longer required

Your circumstances have changed. Confirm current eligibility before requesting cancellation.

Eligibility depends on the applicable law and facts. Reference: CGST Act, Section 29.

ANSWERS BEFORE YOU START

GST cancellation FAQs.

Practical answers about eligibility, GST surrender, pending obligations, final returns and revocation.

What is GST registration cancellation?

GST registration cancellation ends the registration from the effective date stated in the order. It may be requested by an eligible registered person or initiated by the proper officer. It does not erase obligations for earlier periods.

When can a business apply for GST cancellation?

Reasons can include discontinuing the business, a full transfer or merger, a change in constitution, or no longer being liable to register. Eligibility depends on the circumstances and applicable GST provisions.

Which form is used to surrender or cancel a GST registration?

Form GST REG-16 is the application for cancellation of registration. The cancellation order is issued in Form GST REG-19. Preparing an application and receiving an approved cancellation order are separate stages.

Does GST cancellation remove pending tax dues?

No. Cancellation does not remove tax, other dues or compliance obligations relating to periods before cancellation. Review pending returns and liabilities as part of your closure plan.

Do I need to pay anything for stock or capital goods on cancellation?

GST cancellation can involve a liability relating to input tax credit on stock and capital goods. The calculation depends on the applicable provisions and asset records. Have those records reviewed before finalising the cancellation and final return.

Is GSTR-10 required after GST cancellation?

A final return in Form GSTR-10 is required for applicable cancelled registrations. The GST flyer identifies exclusions including composition taxpayers, input service distributors, non-resident taxable persons and GST TDS/TCS categories. Check your registration category rather than assuming every cancellation requires it.

What is the due date for the GST final return?

Where required, the final return is due within three months of the date of cancellation or the date of the cancellation order, whichever is later. Track the applicable dates in the order and check any relevant notified relief.

What is the difference between GST cancellation and revocation?

Cancellation ends a registration. Revocation seeks to restore a registration cancelled by the officer on their own motion. The revocation route is not available when cancellation was approved on the taxpayer’s or legal heir’s own request.

What is the time limit for GST cancellation revocation?

Rule 23 provides a 90-day application period from service of the cancellation order for eligible officer-initiated cancellations. An extension of up to a further 180 days may be allowed on sufficient cause by the prescribed authority. Extension and approval are not automatic.

Should I stop filing GST returns as soon as I submit a cancellation request?

Do not assume that submitting a request clears outstanding filing obligations. Check the GSTIN status, suspension and effective dates, relevant periods and applicable rules. Plan any outstanding returns and final-return requirement with a reviewer.

Can I withdraw a GST cancellation application?

The GST Portal provides a withdrawal facility for a REG-16 cancellation application where the tax officer has not initiated action on it. Check the current application status and available portal options before relying on withdrawal.

What documents should I prepare for GST cancellation?

Prepare your GSTIN, registration details, reason and proposed date of cancellation, supporting closure or transfer records, recent returns, liability information and stock or asset records. Requirements depend on your case. If there is a notice or order, include its reference and service date.

How long does GST cancellation take, and what does assistance cost?

The timeline depends on application completeness, queries and government processing. Corporate Mitras can provide a quote after reviewing your GSTIN status and records. Confirm whether the scope includes pending returns, liability review or GSTR-10. No fixed approval date is guaranteed.
